Is it only me that thinks there is something wrong with the AFL threatening legal action over posts to a website ? Which in turn ultimately closed it down ?
I don't know any facts but from what I read earlier on I have a different perception of the HHQ stance. I think they closed for various reasons, and their recent hassles were the straw that broke the camel's back. They didn't have to close it down to please the AFL, they had to remove their copyright material. Another site was demanded to do the same thing a couple of years ago and they complied.
Reading Mocca's post he was sick of the idiots who love to hide behind a keyboard and harass others as well as the threats of legal action from various sources. I understand that and know where he's coming from. We have exactly the same issues.
There are various worries in regard to legal action. Breaching copyright is one. I'm very disappointed that Sportal came the heavy like they did rather than just send a friendly request. I'd be disappointed if the AFL came the heavy on PRE. When all's said and done I'm sure these sites make money for, and generate traffic to, their official sites so it seems a bit petty to me.
Another concern is defamatory or false comments. Anyone has a right to take civil action against a webmaster. It might be a bit harder to police with blogs, not that I know much about them, but it wouldn't take the computer crime squad too much effort to track me down. Our hosts would also become involved with demands they remove the site from their server. They are very good to us and I hope they're never put in an awkward position because of us.
What is disappointing is when posters get up in arms if certain posts are deleted if the mods think they might be a concern. I'd hope nobody ever follows through with their threats of legal action, but I see no point in risking it either. I don't have the money to fight them and I like a hassle free life.
It's not so much restricting free speech as it is a matter of self preservation.
On another topic I know some sites are becoming member only now, ie you have to be registered and logged in to read the forums. I've spoken to the admins of another unofficial AFL club forum and they feel it makes things harder for the yobbos if they have a closed site.
Does anyone here post on a closed forum where they have to be logged in to read it? I can see pros and cons for the idea.
