Why is the government getting dragged into anti vaccine sentiment, protests etc ? Has nothing to do with it.

Just stick to the point of law - the immigration minister’s rights and the fact that he didn’t meet the exemption criteria and he supplied incorrect information on his application both of which support the minister’s rights and his decision. And then highlight the perils of not upholding that capability for Australia should they allow him to stay.

The government appear to be blowing this by going down a vague, irrelevant and easily countered path.
I don’t understand why their attack isn’t ‘he handed in a false declaration on his documents’ it’s provable, it’s a deportable offence and he’s admitted it. This anti vax thing isn’t any of those and is going to be something his lawyers can defend against.

Totally agree. Hawke has stuffed this with the reasoning behind the decision. As you say, you state its due to the false declaration and what can the court decide? Leave it open and say he's a danger to society when Covid is already rampant, and I highly doubt it will stick.

IMO the reasoning given will be easily overturned by the Federal Court. He'll be playing tomorrow.

I suspect the reasons given are those which would be the hardest to conclusively rebut. Deliberately open with "may, could, might". This would have been under advisement from their QCs so that they could maximise their earnings. Do QCs get double overtime rates for working Sundays? What about oncall allowance?

My thoughts too.

It's as if they want to be seen to be doing something, while making it easy for Novax and his lawyers to win their appeal.

yeah I don't see that. Government losing 2 appeals will make them look stupid. Government kicking out Novax will let them play the big strong government who sticks to it's guns and fights for whats right.

The only issue they have is if they do kick out Novax for enticing the anti-vaxxer nutjobs, what does that mean for Christensen?

Be better if he disputes a call in his first match and is defaulted out of the tournament ala McEnroe. Novax himself was defaulted out of the 2020 US for accidentally hitting a ball into a linesperson’s throat.

be even better if it turns out he 'positive test' was a fake, he tests positive for real, infects everyone on the men's comp and it is cancelled.

This has been stuffed up my many but imo it came down to a desire by ( not sure who, maybe TA) to get him here.

Hopefully he pays the court costs before leaving tonight . Total disgrace it’s gone this long . Over the rubbish . Lies in his application and think he is privileged. Seriously!!
