We can’t judge the validity of his claim because we don’t really know what happened but I think of it in these terms. If I went out at night and where I was and what I was doing was not associated with my employment, and then clocked someone why would that have anything to do with my employer?
Any dealings with my employer would be related to the terms of my employment contract but if the victim is due compensation I can’t see how that has anything to do with who I work for?
Maybe there is a lawyer on the site to comment but I haven’t heard of anything like this before.
Yeah was on the news, going to be sued because no remorse shown by Balta. Went silent- which is prob what he was told to do. Guessing one wouldn’t be remorseful if u thought the guy deserved it (provoked, initiated, etc)
Who deserved, provoked or initiated is totally invalid and irrelevant. Balta has given a statement to police and indicated through his legals that he intends to plead guilty to the charges, he'll then cop whatever punishment the court hands down. Somebody's legals is simply trying to scrounge a payout by trying to embarrass Balta's employers rather than directing their grievance and compo claim directly at Balta through his legals.
Got nothing to do with any employer anywhere in the world if an employee cuts up rough during their own personal private time, only if the employee is out on official company time n duties could they be held in some way accountable.
Wouldn’t his remorse or lack there of be pursuant to the actual court case and sentencing?
If Balta had contacted the victim prior to the court case to offer remorse, couldn’t that be seen as him trying to interfere with outcome of the trial?

That’s absolutely right but there is nothing he can do about that now, it’s done.
He can only control what he does now and in the future and all the noises out of the club is he is doing the right things.

The courts will deal with this issue and what happens will happen but I will say one thing.

If there is a claim for compensation that will go to a court as well. I suspect the victim and the lawyer don’t want it to and are putting pressure on for a private settlement.
Court mandated compensation settlements like this would require expert medical opinions on the extent of the injuries
